General Cancellation Policy

This General Cancellation Policy (“Policy”) sets out the terms and conditions governing the cancellation of services provided by NexusHub Training & Development Inc. (“NexusHub,” “we,” “our,” or “us”). This Policy is intended to ensure clarity, fairness, and compliance with applicable Canadian laws.

This Policy applies unless otherwise stated in a written agreement. Where a service-specific or contract-specific cancellation policy exists, that policy shall prevail.

Client-Initiated Cancellations

Cancellation timelines are calculated from the confirmed project or service start date.

14 Days or More Before Project Start Date

Clients who cancel at least fourteen (14) calendar days prior to the scheduled start date are eligible for a refund of prepaid fees, less any non-refundable deposit and any fees for work already completed or costs already incurred, where applicable.

7 to 13 Days Before Project Start Date

Cancellations made between seven (7) and thirteen (13) calendar days prior to the start date will incur a cancellation fee equal to five percent (5%) of the total service fee, in addition to any non-refundable deposit and any completed or committed costs.

On or After the Project Start Date

Cancellations made on or after the project start date will incur a cancellation fee equal to twenty-five percent (25%) of the total project or service fee, plus any non-refundable deposit and the full cost of work performed, resources allocated, or expenses incurred up to the date of cancellation.

Service-Specific Cancellation Policies

Certain services, programs, or deliverables may be subject to separate or additional cancellation terms, which will be disclosed at the time of contracting. By proceeding with a purchase or engagement, the client agrees to the applicable service-specific cancellation policy.

NexusHub’s Right to Suspend or Terminate Services

NexusHub reserves the right to suspend or terminate services immediately, without refund, in the event of:

  • Material breach of contract

  • Client misconduct, misrepresentation, or non-cooperation

  • Failure to make required payments

  • Any action that interferes with project delivery, staff, partners, or reputation

In such cases, all outstanding balances become immediately due, and NexusHub shall not be liable for any refunds.

Limitation of Liability & Costs

To the maximum extent permitted by law, NexusHub shall not be liable for indirect, incidental, or consequential damages arising from cancellation or termination.
Where legal action is required to enforce this Policy or an associated agreement, the client agrees to be responsible for all reasonable legal and recovery costs incurred by NexusHub, where permitted by law.

How to Request a Cancellation

All cancellation requests must be submitted in writing by email to info@nexushub.ca or through NexusHub’s official website contact form.
Cancellations are effective only upon written confirmation from NexusHub.

Force Majeure / Exceptional Circumstances

In the event of extraordinary circumstances beyond reasonable control (including natural disasters, public emergencies, or government restrictions), NexusHub may, at its sole discretion, waive or adjust cancellation fees. Supporting documentation may be required. Any such accommodation does not constitute a waiver of future enforcement.

Policy Review and Amendments

NexusHub reserves the right to update or amend this Policy at any time. The version in effect at the time of contract execution shall apply unless otherwise required by law.

Acknowledgment

By engaging NexusHub’s services, the client acknowledges that they have read, understood, and agreed to this General Cancellation Policy and any applicable service-specific cancellation terms
